Deposit disputes
How long does a landlord have to return a deposit?
Under the scheme rules set by the Housing Act 2004, once the amount to be returned is agreed, the deposit must be repaid within 10 days.

Step by step
- Tenancy ends and you hand back the keys.
- Check-out inspection takes place.
- Landlord proposes any deductions; you agree or dispute.
- Once agreed, the deposit is repaid within 10 days.
- If disputed, the scheme's ADR decides, then repayment follows promptly.
If your landlord doesn't respond
For custodial schemes (DPS Custodial, TDS Custodial) you can apply directly to the scheme for repayment if the landlord fails to respond. For insured schemes, raise a dispute with the scheme, which can require the landlord to pay the disputed sum to it within 10 days.
Time limits
Raise disputes within three months of the tenancy ending. A s214 compensation claim for non-protection can be made up to six years after the breach under the Limitation Act 1980.
