After the tenancy
Claiming after you have moved out
Since the Localism Act 2011 amended section 214, tenants can bring a deposit protection claim after the tenancy has ended. Many successful claims are brought this way.

Time limit
Claims are generally subject to a six-year limitation period from the date of breach. Older breaches in earlier tenancies may already be time-barred, so act promptly.
Even if the deposit was returned
Getting your deposit back does not cancel the breach. If it was never protected, or protected late, you can still claim the 1x–3x penalty.
What to gather
- Tenancy agreement(s) and any renewals.
- Bank statements showing the deposit payment.
- Scheme search results or protection certificate.
- Messages with the landlord or agent.
Frequently asked questions
My deposit was returned in full — can I still claim?
Yes. The penalty is for failing to protect, not for withholding money.
I moved out five years ago — is it too late?
Possibly not, but the six-year clock may be close. Check dates with the calculator straight away.
